Shareholder Dispute
A healthcare professional is in a dispute with their associate. In the professional association agreement they signed, a non-competition and non-reestablishment clause is included. Given the context of the dispute, this clause triggered issuess for the client’s future career.
YL Avocats intervened to protect the interests of the associate subject to this clause. The law firm urgently filed a fixed-date application with the civil court to have the non-competition clause declared invalid and to allow the client to establish their practice within the same municipality.
Following the expedited procedure, the Court nullified the clause and authorized the client to establish their practice in the municipality of their choice.
